These Terms of Service ("Terms") govern your access to and use of Hubty, a product operated by MNB Teknoloji Danışmanlık Sanayi ve Ticaret Ltd. ŞTi. ("MNB," "we," "us," or "our"). By using Hubty, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using Hubty, you agree to be bound by these Terms and our Privacy Policy. If you are using Hubty on behalf of an organization, you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these Terms.

2. Description of Services

Hubty is a software-as-a-service (SaaS) platform that provides AI-powered content generation tools, including but not limited to blog posts, articles, SEO content, and testimonials. We may update or modify features from time to time at our sole discretion.

3. User Accounts and Responsibilities

a. Account Creation

You must provide accurate and complete information when creating an account and update your information to keep it accurate. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

b. Account Security

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

c. Account Termination

We reserve the right to suspend or terminate your access to Hubty at any time, with or without cause or notice, including but not limited to breaches of these Terms.

4. Fees and Payment

a. Subscription Plans

Hubty offers both free and paid subscription plans. Features available to you will depend on your selected plan.

b. Payment Processing

All payments are processed by third-party services such as Stripe or Paddle. By subscribing, you agree to the pricing, billing terms, and automatic renewal unless you cancel before the next billing cycle.

c. Refunds

All payments are non-refundable except where required by law. If you are dissatisfied with the service, please contact our support team.

5. Intellectual Property Rights

a. Your Content

You retain ownership of the content and inputs you provide. You also retain the rights to the AI-generated outputs, subject to our right to use anonymized and aggregated data for service improvement.

b. Hubty Content

All content, branding, and code that form part of Hubty (excluding your content and AI outputs) are owned by MNB and are protected by intellectual property laws. You may not copy, distribute, or create derivative works without our written permission.

6. User Conduct and Acceptable Use

You agree not to:

• Use Hubty for any unlawful, harmful, or fraudulent purposes
• Violate intellectual property, privacy, or publicity rights
• Upload or transmit viruses or malicious code
• Interfere with or disrupt the platform or services
• Use automated systems to scrape or interact with the platform unless explicitly permitted

We reserve the right to monitor usage and remove content or terminate accounts that violate these Terms.

7. Service Availability and Modifications

We aim to provide reliable services but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features or the entire service at any time without notice.

8. Data Privacy

Your use of Hubty is subject to our Privacy Policy. By using the service, you consent to the collection and use of information as described in the policy.

9. Disclaimers

Hubty is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the service will be error-free, secure, or continuously available.

10. Limitation of Liability

To the fullest extent permitted by law, MNB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the event.

11. Indemnification

You agree to indemnify and hold harmless MNB, its affiliates, officers, agents, and employees from any claims, damages, or expenses arising from your use of Hubty, your violation of these Terms, or your infringement of any rights.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Republic of Turkey. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

13. Changes to Terms

We may update these Terms from time to time. Continued use of Hubty constitutes your acceptance of any changes. We encourage you to review the Terms regularly.
